Terms of Service
These Terms of Service (“Terms”) govern your use of the Site and the services offered by Elite Notaries of Florida. By accessing the Site or submitting a request, you agree to these Terms.
1. Our Services
Elite Notaries of Florida is a mobile notary and signing-service company that coordinates Florida-commissioned notaries and certified signing agents for real estate closings, loan signings, refinances, seller packages, deed signings, reverse mortgages, remote online notarization (RON), and general notarizations.
2. Requests and Scheduling
Submitting a request does not create a confirmed appointment. An appointment is confirmed only when we communicate confirmation to you. Availability, timing, and coverage are subject to signing-agent availability and the details you provide.
3. Your Responsibilities
- Provide accurate and complete information about the signing;
- Ensure each signer is present, willing, aware, and has valid, government-issued photo identification as required by Florida law;
- Provide accurate documents and clear return/scanback instructions; and
- For RON, ensure signers meet eligibility requirements and have a compatible camera-equipped device and valid ID.
4. Fees and Payment
Fees, payment terms, and travel charges are as quoted for your request or as set out on our booking platform. Confirmed appointments may be cancelled or rescheduled without charge up to two (2) hours before the scheduled appointment time. Cancellations made after that window, no-shows, or appointments that cannot be completed for reasons outside our control — including a signer being unavailable, lacking valid government-issued identification, being unable or unwilling to sign, or documents not being ready — may be subject to a trip and/or document-preparation fee. Fees for notarial acts and signing services already performed are non-refundable. For remote online notarization (RON), fees apply once the session has begun. Florida statutory notary fees are charged in accordance with applicable law; travel, convenience, and after-hours fees are separate and will be disclosed before your appointment.
5. Notary Standards
Our notaries are Florida-commissioned and follow applicable Florida notary laws. A notary may decline to perform a notarization where required by law (for example, if a signer lacks proper identification, appears unable to understand the transaction, or appears to be acting under duress).
6. Intellectual Property
The Site and its content, including text, graphics, logos, and design, are owned by or licensed to Elite Notaries of Florida and may not be copied or reused without permission.
7. Disclaimers
The Site and services are provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free.
8. Limitation of Liability
To the fullest extent permitted by law, Elite Notaries of Florida will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the Site or services. [Confirm any liability cap with counsel.]
9. Indemnification
You agree to indemnify and hold harmless Elite Notaries of Florida from claims arising out of your breach of these Terms or your misuse of the Site or services.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be subject to the exclusive jurisdiction of the state or federal courts located in Hillsborough County, Florida.
11. Changes to These Terms
We may revise these Terms at any time by posting an updated version to this page. Continued use of the Site constitutes acceptance of the revised Terms.
